PLEASE READ THESE TERMS CAREFULLY BEFORE USING OUR PLATFORM. By accessing or using OffPostPro ("Platform," "Service," "we," "us," or "our"), you agree to be bound by these Terms of Service.

1. Definitions

"User" – Any individual or entity accessing the Platform.
"Military User" – Active duty, veteran, or military family member.
"Property Owner" – User listing property for rent or sale.
"Business User" – Company purchasing advertising services.
"Pro Subscription" – Paid membership plan for enhanced features.

2. Eligibility

2.1 Age: You must be at least 18 years old to use this Platform.

2.2 Authority: If using the Platform on behalf of a company, you represent that you have authority to bind that entity.

2.3 Geographic: The Platform is intended for users in the U.S. associated with military installations.

3. Account Registration

3.1 Security: You are responsible for maintaining the confidentiality of your credentials.

Military Verification

Military Users may be required to verify their status through official documentation (PCS orders, military ID, or DEERS verification). False representation of military status is grounds for immediate termination.

4. Intellectual Property

4.1 Ownership: All content, software, trademarks, logos, and platform functionality are the exclusive property of PRISM Technologies LLC (doing business as OffPostPro) and may not be copied, modified, or reverse engineered.

4.2 Restrictions: You may not use our branding or proprietary data models for commercial purposes without explicit written consent.

5. User-Generated Content

5.1 License: By uploading listings, ads, images, or text, users grant OffPostPro a non-exclusive, royalty-free, perpetual license to use, display, distribute, and promote submitted content solely for operating and marketing the Platform.

5.2 Responsibility: You represent that you own or have the right to post all content you submit.

6. Subscriptions & Refunds

6.1 Billing: Subscriptions are billed via Stripe. You authorize automatic recurring charges based on your chosen plan.

6.2 Refund Policy: All fees are non-refundable. We do not provide refunds or credits for any partial-month subscription periods or unused ad impressions.

6.3 Cancellation: You may cancel your subscription at any time via your account settings. Upon cancellation, you will retain access to paid features until the end of your current billing cycle.

7. Termination & Suspension

OffPostPro reserves the right to suspend or terminate accounts at its sole discretion, without prior notice, for violations of these Terms, suspected fraud, or activities that may harm the Platform or its users.

8. User Responsibilities

You agree NOT to:

Post false or misleading information
Impersonate another person
Harass or abuse other users
Scrape or data mine the Platform
Violate Fair Housing Act
Upload malicious code
Modify or reverse engineer software
Interfere with Platform security

9. Property Listings

9.1 Accuracy: Property Owners warrant that all listing information is accurate and they have legal authority to list.

9.2 Fair Housing: All listings must comply with the Fair Housing Act. Discrimination is strictly prohibited.

No Brokerage Disclaimer

OffPostPro is NOT a real estate broker. We do not verify property ownership, conduct background checks, or participate in negotiations. Users are responsible for their own due diligence.

10. Business Advertising

10.1 Performance: Ad performance depends on user activity and market conditions. No guarantees on specific leads or ROI.

10.2 Ad Removal: We reserve the right to remove any advertisement that violates our community standards.

11. Disclaimers

11.1 "As Is": The Platform is provided on an "as is" and "as available" basis without warranties of any kind.

11.2 No Endorsement: OffPostPro does not endorse, verify, or guarantee any user, property, or business advertised on the Platform.

11.3 Third-Party Services: The Platform integrates third-party services (e.g., Stripe, analytics). We are not responsible for outages, errors, or acts of these third-party providers.

AI Accuracy Disclaimer

SmartPCS Match™ and other AI features are for informational purposes only. Algorithms may contain errors and are not a substitute for human judgment or professional advice.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OFFPOSTPRO SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, OR CONSEQUENTIAL DAMAGES. OUR TOTAL LIABILITY IS CAPPED AT $1 OR THE TOTAL PAID IN THE LAST 12 MONTHS.

13. Military Protections

OffPostPro recognizes the protections afforded by the Servicemembers Civil Relief Act (SCRA).

Active Duty Protection

Active duty service members may cancel Pro subscriptions without penalty at any time. Per our standard policy, no refunds are provided for months already paid.

14. General Provisions

14.1 Privacy: Your use of the Platform is subject to our Privacy Policy.

14.2 Governing Law: These Terms are governed by and construed in accordance with the laws of the State of Georgia.

14.3 Force Majeure: OffPostPro is not liable for delays or failures due to events beyond our reasonable control.

14.4 Severability: If any provision is deemed unenforceable, the remaining provisions will remain in full effect.

14.5 Modification: We may update these Terms at any time. Continued use of the Platform constitutes acceptance of the revised Terms.

15. Dispute Resolution

Any dispute will be resolved through BINDING ARBITRATION in Liberty County, Georgia. You waive your right to participate in a class-action lawsuit.
